No visa to foreigners visiting India for surrogacy :
New Delhi : FRRO, The Indian missions and Foreigners Regional Registration Offices was directed by the Home Ministry, Announcing withdrawal of an earlier notification of July 2012 has now finally made a decision not to grant visa to couples who are intended to visit India for the purpose of surrogacy treatment.
“This is (tourist visa) not the appropriate visa category and such foreigners will be liable for action for violation of visa conditions. The appropriate visa category will be a medical visa,” the order said.
“However, for child or children born through surrogacy already commissioned on or before issue of this circular, exit permission will be decided by FRRO on case to case basis,” the notification said.
In an affidavit to the Supreme Court late last month, the government had said “it would henceforth “prohibit and penalize commercial surrogacy services” to protect the “dignity of Indian womanhood”, and to prevent “trafficking in human beings” and the “sale of surrogate child””.
For all those who are granted visa for this treatment should be informed to the respective country position immediately as they get to know about it.
However, the notification said, for child born through surrogacy already commissioned on or before issue of this circular, exit permission will be decided by FRRO on case to case basis.
